1. Eligibility
(a) By participating in this Promotion, each participant warrants and agrees to be bound by these Terms and Conditions. All rules and regulations and instructions issued by ECOGENICA® from time to time will be deemed incorporated in these Terms and Conditions.
(b) This promotion is NOT applicable to participants.
(c) This promotion is NOT applicable to customers who purchased Display Model(s).
(d) To the maximum extent permitted by law, ECOGENICA® reserves the right to change the eligibility criteria as stated herein at any time (with or without notice or reason) and/or determine at its sole discretion whether any participant should be excluded from entering or participating in the Promotion.
2. Promotion Period
This Promotion will start on 13th January 2025 until 30th April 2025. Installations undertaken between these dates will qualify and the customer will have 14-days from installation wherein they can claim the cashback. Therefore the final date that a customer can claim the cashback would be 14th May 2025 for any installations completed on the 30th April 2025.
3. Promotion Mechanics
To qualify for this Promotion, customers must:
Have an installation completed within the promotion period and register for the cashback which includes the submission of a photo of their tank serial number along with the required details of the customer and installer as stated in this webform;
Any installation of a residential or commercial product purchased within the above detailed promotion period will receive a bank transfer payment of $179 (inc gst).
4. Redemption period
Customers must submit their details via this webform within 14-days of their installation. The installation must have been completed during the above promotion period.
5. Other Terms:
(a) By participating in this Promotion, each participant agrees and consents that in any personal data given by him/her to ECOGENICA® is accurate and allow us to use it for marketing purposes in organizing, conducting, managing, and administering this Promotion.
(b) All the successful entries will be kept confidential with ECOGENICA®.
(c) ECOGENICA® reserves the right to disqualify any participant who did not meet the following requirements:
Suspected of fraud; or dishonest with the given information of the invoice details and product serial number during the prize collection, ECOGENICA® will forfeit their winning prize.
(d) ECOGENICA®’s artworks shown are for illustration purpose only. Actual product may vary due to product enhancement. ECOGENICA® reserves the right to change the product images and any specifications at any time without prior notice.
(e) ECOGENICA® reserves the rights to revise any of the terms under these terms and conditions (including but not limited to varying the Promotion Period or Prize collection Deadline), or withdraw or alter any part of this Promotion at any time without prior notice and/or assuming any liability to any party.
(f) The above terms and conditions of this Promotion will be construed, governed, and interpreted in accordance with the laws of Australia.
(g) The decisions of ECOGENICA® on all matters relating to or in connection with the Promotion are final, conclusive and binding. ECOGENICA® shall not be obliged to give any reason or enter any correspondence with any person on any matter concerning the Promotion.
(h) ECOGENICA® shall not be responsible for any injury, loss or damage suffered as a result of, or in connection with the Promotion and/or redemption or use of the Prizes howsoever arising, including but not limited to, fulfilment of the prize(s), any error in computing chances, any breakdown or malfunction in any computer system or equipment, any notice which is misdirected and/or lost in the post, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties howsoever arising whether in contract, tort, negligence or otherwise. For the avoidance of doubt, cancellation, termination, or suspension by ECOGENICA® of this Promotion shall not entitle any party to any claim or compensation against shall for any and all losses or damage suffered or incurred as a direct or indirect result of the act of cancellation, termination or suspension.
(i) In the event of any inconsistency between these Terms and Conditions and any advertising, promotional, publicity and other materials relating to or in connection with the Promotion, these Terms and Conditions shall prevail.
(j) A person who is not a party to any agreement governed by these terms and conditions shall have no rights under the Contracts to enforce any terms of such agreement.
