ECOGENICA® Cashback Promotion Terms and Conditions
1. Background:
1.1 This Cash Back Promotion will enable customers who have only purchased ECOGENICA® EG-330FRE/C/C-W/C-WR/-WR Product model range that were installed between 28 January 2025 to the 25 April 2025 to receive AUD $180.00 Cash Back.
1.2 These terms and conditions govern this Cash Back Promotion.
1.3 By participating in this Cash Back Promotion, you agree to and accept these terms and conditions.
1.4 Instructions on how to apply and claim the Cash Back Promotion form part of these terms and conditions.
1.5 This Cash Back Promotion cannot be combined with any other offer by ECOGENICA®.
1.6 To qualify for the Cashback, customers must adhere to these terms and conditions in full.
1.7 Eligible customers will receive a Cash Back of AUD $180.00.
2. Cash Back Timeline:
Commencement to make an application for a cash back time and date: 12:01 AM, 28 January 2025
Final submission of the application of cash back time and date: 11:59 PM, 25 April 2025
Note: however, should an installation be carried out from the 21 April to the 25 April 2025, consumers will have until 11:59 PM on the 4 May 2025 to make their final application for the cash back.
No application or submission will be accepted after the final submission date.
ECOGENICA® may at any time throughout the above period stop and withdraw the cash back due to any business or operational needs.
3. Cash Back:
The Cash Back will be provided via an Electronic Funds Transfer to only eligible customers who have a designated Australian Bank Account only. The bank account must be located in Australia.
The amount for the Cash Back is limited to AUD $180.00.
3.1 Eligibility Requirements:
1 ECOGENICA® EG-330FRE/C/C-W/C-WR/-WR Product model range installed between 28 January 2025 to the 25 April 2025 is the only product model range that is part of this Cash Back Promotion. No other Ecogenica products, units or ranges manufactured and supplied to the public form part of this Cash Back Promotion.
2 All customers have 14-days from installation to apply for and claim this Cash Back Promotion.
3 This Cash Back Promotion is limited to a single applicant and property. There cannot be multiple applications made by the same applicant for a single or multiple properties.
4 However, more than one application for a cash back is allowed where an applicant owns multiple properties. This means that an applicant who owns multiple properties can make more than one application for a cash back. Note though that the cash back will only apply to a single product per property. An applicant cannot apply for multiple cash backs for a single property.
(This includes flats, units and apartments. Thus, where there are multiple dwellings on a property, the cash back is only available to a single dwelling).
5 Only the end consumer who has purchased the product, can undertake the process to apply for this Cash Back Promotion.
6 Participants who have claimed a rebate from the Solar Victoria hot water rebate scheme are NOT eligible.
7 By participating in this Cash Back Promotion, each participant warrants and agrees to be bound by these Terms and Conditions. All rules and regulations and instructions issued by ECOGENICA® from time to time are incorporated in these Terms and Conditions.
8 This Cash Back Promotion is NOT applicable to customers who purchased Display Model(s).
9 This Cash Back Promotion is NOT available to related entities of ECOGENICA® including Eco Alliance Pty Ltd and Eco Light Up Pty Ltd.
10 This Cash Back Promotion is NOT available to employees and their immediate families or contractors of the ECOGENICA®, Eco Alliance Pty Ltd or Eco Light Up Pty Ltd. Immediate family member constitutes a spouse, former spouse, de facto partner, child or step child (whether biological or adopted), parent, step parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, sibling, step sibling or first cousin.
11 To the maximum extent permitted by law, ECOGENICA® reserves the right to change the eligibility criteria as stated herein at any time (with or without notice or reason) and/or determine at its sole discretion whether any participant should be excluded from entering or participating in the Promotion.
12 This Cash Back Promotion is only available to individuals over the age of 18.
13 Proof of age must be provided when making a submission, e.g. Drivers Licence and/or Passport Number.
14 This promotion is only available in the State of Victoria.
4. How to apply:
1 Simply register your details by completing the webform above.
2 Include a photo of your tank model number compliance plate and serial number.
3 Include proof of purchase that must outline the date of purchase.
4 Include proof of the installation that must outline the date of installation.
5.Include proof of age.
6 For businesses we require an ABN.
7 Adhere to the full terms and conditions are outlined throughout this Cash Back Promotion.
8 Must provide a contact email address and contact number.
4.1 Verification of Application Information:
ECOGENICA® will review all submitted information, forms, invoices, proof of age and purchase amongst others by all applicants.
Where an applicant has submitted forms, invoices or other information that is not clear and can be verified, ECOGENICA® reserves the right to disregard the application and inform the applicant to resubmit the required information, forms, invoices amongst other.
Where the dates or other information provided on invoices or other documents is not readable or meet the promotion period, ECOGENICA® reserves the right to either cancel the application, without informing the applicant, or, request the applicant to resubmit the relevant document/s and/or information.
Where the applicant has been informed by ECOGENICA® to resubmit information and/or documents, this must be undertaken within 7 days from notification by ECOGENICA®. A failure to meet this time line will result in your application being cancelled.
An applicant will be informed via email of a cancelled or rejected application. An applicant will be informed via email of the need to resubmit any documents or information.
At any time throughout the Cash Back Promotion and post the Cash Back Promotion expiry date for a period of 3 months ECOGENICA® is able to request from an applicant any further information.
4.2 Notification of Claim
The applicant will be informed via email of the success of their application, and an estimated period of time the Cash Back will be transferred electronically to their bank account.
4.3 Return of Products
Where an applicant returns the ECOGENICA® EG-330FRE/C/C-W/C-WR/-WR Product model range for a refund or exchange, the applicants is no longer eligible for the Cash Back.
Where the ECOGENICA® EG-330FRE/C/C-W/C-WR/-WR Product model range is returned to ECOGENICA® after the expiry of the Cash Back period, and the applicant has received the cash back, the Cash Back amount of AUD$180.00 is to be returned to ECOGENICA® in full, within 30 days of notification of the requirement to return the cash back amount.
The above does not limit an applicant-customer’s rights pertaining to warranties provided as part of the purchase of ECOGENICA® EG-330FRE/C/C-W/C-WR/-WR Product model range.
4.4 Verification and Disqualification
ECOGENICA® may verify the validity of claim/s and applicant/s (including identity, contact details, tax invoice, and any other information-documentation required to be provided) and disqualify any applicant who does not comply with these Terms and Conditions or tampers with the claim process. ECOGENICA®’s decision is final and there is no option for an appeal.
4.5 Dispute Resolution
In the event there is a dispute between the applicant and ECOGENICA®, the parties agree to go to either mediation or arbitration.
4.6 Rights Enforcement
Failure by the ECOGENICA® to enforce any of its rights at any stage does not constitute a waiver of those rights.
4.7 Invalid Claims
Applications that are incomplete, unclear, or unreadable will be considered invalid. It is the applicant’s responsibility to ensure that their email, bank account, address details and all other information is readable and accurate. See section 4.1 whereby ECOGENICA® may request an applicant to resubmit documents and other information.
ECOGENICA® will not be held liable if the applicant does not receive the Cashback due to incorrect information or invalid serial numbers.
4.8 Electronic Funds Transfer [EFT]
Cashback will be disbursed exclusively to Australian bank accounts.
ECOGENICA® bears no responsibility for any payment complications arising from the
applicant’s lack of an Australian bank account.
ECOGENICA® will make up to three (3) attempts only to transfer the Cashback via EFT. Where all attempts fail, the Cashback will be forfeited.
Applicants are required to inform the ECOGENICA® immediately if incorrect bank details were provided.
In the unlikely event an EFT has been sent to an incorrect account, the ECOGENICA® will make an attempt to reverse the transaction. A reissuing fee will be applied. However, ECOGENICA® does not guarantee the success of EFT reversals.
Applicants should allow thirty (30) days from the approval email for the EFT to be processed. Additional time may be required for bank clearance.
The Cash Back is non-transferable and can only be claimed by the person named on the tax invoice. Claims must be made by the actual purchaser of the Participating Product. Third-party claims are not accepted.
In the event that this Cash Back is disrupted or cannot be conducted as planned due to circumstances beyond the ECOGENICA®’s control, ECOGENICA® reserves the right to disqualify any applicant or modify, suspend, terminate, or cancel the Cash Back in full, before the expiry date of 25 April 2025.
Applicants are responsible for any costs incurred in completing the Online Claim Process and claiming the Cashback, including internet service charges.
ECOGENICA® is not responsible for any server or any other IT issues that may affect the applicant’s ability to make and submit the online application.
Except for liability that cannot be excluded by law, ECOGENICA® (including its officers, employees, and agents) excludes all liability for any personal injury, loss, or damage arising from the Cash Back, including technical difficulties, theft, unauthorized access, claim or documentation loss, Cashback value variation, tax liability, or use of the Cashback.
The applicant is responsible for any tax, duty or other amount.
These Terms and Conditions do not exclude, restrict, or modify any consumer rights under the Competition and Consumer Act 2010 (Cth) or other legislation. ECOGENICA® ‘s liability for breach of such rights is limited to the replacement, repair, or cost of replacement/repair of goods, or the re-supply or cost of re-supply of services.
5. Promotion Period
This Cash Back Promotion will commence on 28 January 2025. Installations undertaken between these dates will qualify and the customer will have 14-days from the date of installation wherein they can claim the cashback.
The final date that a customer can claim the cashback is for installations that have been fully completed by the 25 April 2025 at 11.59pm. Refer to point 2.
6. Promotion Requirements
To qualify for this Cash Back Promotion, a customer applying for the Cash Back must:
(a) Have installed an ECOGENICA® EG-330FRE/C/C-W/C-WR/-WR Product model range within the promotion period.
(b) Application and register for the cashback which includes the submission of a photo of their tank serial number along with the required details of the customer and installer as stated in this webform under How To Apply section 4.
(c) Any installation of a residential or commercial product purchased within the above detailed period will receive a bank electronic transfer payment of no more than $180 (inc GST).
7. Redemption Period
Customers must make, complete and submit their application for the Cash Back via this webform within 14-days of installation of the ECOGENICA® EG-330FRE/C/C-W/C-WR/-WR Product model range.
Customers who fail to make, complete and submit application within 14 days of installation will not be eligible to obtain the Cash Back.
The installation must have been completed during the above promotion period for the Cash Back to be received.
8. Privacy
By participating in this Promotion, each participant agrees and consents that in any personal data given by him/her to ECOGENICA® is accurate and allow us to use it for marketing purposes in organizing, conducting, managing, and administering this Promotion. 9. General Terms and Conditions
a) All the applications whether successful or not will be confidential between the applicant-consumer and ECOGENICA®.
b) ECOGENICA® reserves the right to disqualify any participant who is suspected of fraud or dishonest behaviour when submitting the relevant documents and any other information from the Cash Back.
c) ECOGENICA® reserves the right to withdraw the Cash Back Promotion at any time throughout the period it is provided for any business and/or operational requirements.
d) ECOGENICA®’s artworks that has been shown is for illustration purposes only. The actual product may vary due to product enhancement. ECOGENICA® reserves the right to change the product images and any specifications at any time without prior notice.
e) ECOGENICA® reserves the rights to revise any of these terms and conditions (including but not limited to varying the Cash Back Promotion Period), or alter any part of this Cash Back Promotion at any time without prior notice and/or assuming any liability to any party.
f) The above terms and conditions of this Cash Back Promotion will be construed, governed, and interpreted in accordance with the laws of Victoria and Australia.
g) The decisions of ECOGENICA® on all matters relating to or in connection with the Cash Back Promotion is final, conclusive and binding.
h) ECOGENICA® shall not be obliged to give any reason or enter any correspondence with any person on any matter concerning the Cash Back Promotion.
i) ECOGENICA® shall not be responsible for any injury, loss or damage suffered as a result of, or in connection with the Cash Back Promotion howsoever arising, including but not limited to, any error in computing chances, any breakdown or malfunction in any computer system or equipment, any notice which is misdirected and/or lost in the post, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties howsoever arising whether in contract, tort, negligence or otherwise.
j) For the avoidance of doubt, cancellation, termination, or suspension by ECOGENICA® of this Cash Back Promotion shall not entitle any party to any claim or compensation against shall for any and all losses or damage suffered or incurred as a direct or indirect result of the act of cancellation, termination or suspension.
k) In the event of any inconsistency between these Terms and Conditions and any advertising, promotional, publicity and other materials relating to or in connection with the Cash Back Promotion, these Terms and Conditions shall prevail.
l) A person who is not a party to any agreement governed by these terms and conditions shall have no rights under the contracts to enforce any terms of such agreement.
m) The term applicant has been used to refer to the individual or entity applying for the Cash Back.

How many Cash Back Applications can be submitted?

More than a single application for the cash back can be made, only where the customer is the owner of multiple properties. This means that Jack who owns four (4) properties and has one of ECOGENICA® EG-330FRE/C/C-W/C-WR/-WR Product model range installed at each property, can apply for four (c4) cash backs.
However, there can only be one application per property.
Where a customer installs one or more product ranges on a single property, they will only be entitled to apply for a single cash back.
Is the Cash Back Restricted to any number of Properties?
Yes. An application for the cash back is restricted to a single property. Multiple application for a single property will be rejected, and the customer will be ineligible to apply or receive the cash back.
